5 Mile Smiles Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy explains how 5 Mile Smiles, the practice of Dr. Jason Keefe (“we,” “us,” or “our”), collects, uses, shares, and protects consumer health data under the Washington My Health My Data Act, RCW Chapter 19.373.

This policy applies to Washington residents and to anyone whose consumer health data we collect in Washington, including through our website at https://5milesmiles.com/.

This policy is separate from, and in addition to:

• Our Privacy Policy, which covers our website more broadly.
• Our Notice of Privacy Practices, which covers protected health information in your patient records under HIPAA. Information covered by HIPAA is governed by that notice, not this policy.

If this policy conflicts with our Privacy Policy on consumer health data, this policy controls.

1. Consumer health data we collect

Because our website relates to dental care, some information we collect may be considered consumer health data, including:

• Contact information you submit when you request a consultation or appointment, such as your name, phone number, and email address. Submitting this tells us you are seeking care.
• Website activity linked to your visit, such as the pages you view, your IP address, device and browser information, and cookie identifiers, when connected to the health care context of our site.
• General location, such as city or region derived from your IP address.
• Referral information, such as the search, website, or ad that brought you to our site.
• Call and chat information, if you call a tracked phone number or use chat on our website, such as call details and the messages you send.

Our forms ask for contact information only. Please don’t include details about your health or treatment in a website form or chat.

2. How we collect it

• Directly from you, when you fill out a form, call, chat with us, or contact our office.
• Automatically, through cookies and similar technologies on our website, such as Google Analytics, after you have given consent through our cookie banner.
• From advertising platforms: if we run ads, we may receive information from platforms such as Google and Meta (Facebook and Instagram) when you click one of our ads or submit a lead form inside those platforms.

3. Why we collect and how we use it

We use consumer health data only for these purposes:

• Responding to your consultation or appointment request
• Scheduling and communicating with you about your visit
• Understanding how visitors use our website so we can improve it
• Measuring which searches, and any ads we run, bring people to us
• Keeping our website and systems secure
• Meeting our legal obligations

We will not collect or use consumer health data for any other purpose without first telling you and getting your consent.

4. Who we share it with

We share consumer health data only with service providers who help us run our practice and website, and only for the purposes above. These include:

• Form, lead management, and communication providers

• Advertising platforms, such as Google and Meta, if we run ads

We may also share consumer health data when required by law, or with your consent. We do not share consumer health data with any other third parties or affiliates. You can request a list of the specific companies we share with (see Your rights below).

5. Your consent

Website tracking: When you first visit our site, our cookie banner asks for your choice. Analytics and advertising technologies run only after you click Accept. If you click Reject, they stay off.

Forms: When you submit a form, you consent to us collecting your contact information to respond to your request, and to the form tracking described in this policy.

Withdrawing consent: You can change your cookie choice at any time using the Cookie Settings link at the bottom of our website, or withdraw any consent by emailing info@5milesmiles.com. Withdrawing consent won’t affect your ability to get care from us.

6. Your rights

Under the My Health My Data Act, you have the right to:

• Know whether we collect, share, or sell your consumer health data, and see that data
• Get a list of all third parties and affiliates we have shared it with, and how to contact them
• Delete your consumer health data, including from our service providers
• Withdraw consent to our collection and sharing of your consumer health data

How to make a request: Email info@5milesmiles.com or call (509) 326-2621. We may ask for information to verify your identity before acting on your request.

Timing: We will respond within 45 days. If we need more time, we may extend once by up to 45 more days and will tell you why. You can make requests free of charge up to twice a year.

Appeals: If we decline your request, you can appeal by emailing info@5milesmiles.com with “Appeal” in the subject line within 30 days. We will respond within 45 days. If you are not satisfied with our answer, you can contact the Washington State Attorney General.

7. Other commitments

• No sale: We do not sell consumer health data.
• No geofencing: We do not use geofences around health care facilities to identify, track, or send messages to people.
• Security: We limit access to consumer health data to staff and service providers who need it, and use reasonable security practices to protect it.
• No discrimination: We won’t treat you differently for exercising your rights.
• Changes: If we change how we collect, use, or share consumer health data, we will update this policy and its Last Updated date, and get your consent where required.
